Seeking asylum and humanitarian relief can be a daunting, complicated process. There are administrative processes and immigration court procedures to follow. These can be time-consuming and may not provide satisfactory results.

At The O'Brien Law Group, we understand the stress and emotional hardship you may be experiencing. We can help you navigate the process and provide detailed evaluations of your immigration issues to try to provide creative solutions. We also provide in-depth information so that you are prepared and can have realistic expectations.

Our lead attorney, Rusty O'Brien, has more than 10 years of immigration law experience. Throughout his years of experience, he has successfully handled complex political asylum and humanitarian relief cases for his clients. He has assisted individuals and families from a number of regions and countries, including:

  • Mauritania
  • The Middle East
  • Central America
  • South Africa
  • El Salvador
  • Cuba
  • Liberia
  • Rwanda
  • China
  • India

Asylum

You may seek asylum due to political persecution or a well-founded fear of persecution based on five criteria:

  • Race
  • Religion
  • Nationality
  • Political opinion
  • Being a member of a particular social group

The asylum process begins with administrative documentation and filing. Then you must go to your regional asylum office for an interview. If you are granted asylum, you can eventually obtain permanent residence.

We can help you pursue your asylum claim. We travel to every regional asylum office to provide thorough legal support. We can also represent you in your deportation/removal proceedings to help find a solution that keeps you in the United States.

Humanitarian Relief

If your country suffered a severe natural disaster, you may be eligible for humanitarian relief. You could be granted temporary protected status (TPS) and given an 18-month work visa. Your TPS would come up for review every 18 months.

Like asylum, humanitarian relief begins with administrative procedures. Then, you would need to go to an immigration hearing to receive TPS.

Humanitarian Parole

Under humanitarian parole, you may be granted temporary protected status (TPS). This is a subsection of humanitarian relief, which does not automatically provide TPS. Depending on your situation, you may also seek a U visa or T visa.

U visas provide temporary parole for victims of certain crimes, while T visas provide temporary parole for victims of human trafficking.
